Announcement of the Competition "Renting Premises for a Canteen"

This Announcement of the Competition "Renting Premises for a Canteen" (hereinafter referred to as the Announcement) has been developed in accordance with the Rules for Providing Non-Residential Premises for Property Rental (Lease) of the Non-Commercial Joint Stock Company "M. Kozybayev North Kazakhstan University," approved by the decision of the Board of Directors of NJSC "M. Kozybayev North Kazakhstan University" dated March 29, 2021 (hereinafter referred to as the Rules), the decision of the Board of Directors of NKU named after M. Kozybayev No. 13 dated August 28, 2023, due to the need for organizing and providing meals for students and employees of NJSC "M. Kozybayev North Kazakhstan University" (the need for a catering point).

Competition Name: "Renting Premises for a Canteen"

Name and Location of the Competition Organizer: NJSC "M. Kozybayev North Kazakhstan University," Petropavlovsk, Pushkin St., 86 (hereinafter referred to as the Competition Organizer).

1. Date, Time, and Place of the Competition

The meeting of the tender commission to open envelopes with competitive applications from potential tenants to participate in the tender will be held at "15" hours "00" minutes local time, October 14, 2024, at the address: Petropavlovsk, Pushkin St., 86, Building 2, Room 208.

2. Location and Deadlines for Accepting Applications to Participate in the Competition

Applications for participation in the competition are submitted by potential Tenants (lessees) or their authorized persons representing the interests of submitting an application for participation in the competition based on a power of attorney, in a sealed envelope until "15" hours "00" minutes local time, October 14, 2024, to the following address: Petropavlovsk, Pushkin St., 86, Room 208.

An application from a potential Tenant is not accepted after the deadline for accepting applications specified in the announcement.

3. Brief Description and Information about the Rental Object, including its Location, Area, Term of Property Rental (Lease), and Rental Fee approved by NJSC "NKU named after M. Kozybayev."

The Lessee is obliged, before receiving the non-residential premises for lease under the Acceptance Certificate, to deposit (guaranteed monetary contribution) in the amount of 3 (three) monthly rental payments into the Lessor's account within 5 working days from the date of signing the Agreement.

Lot No. 1: Non-residential premises for a canteen, with an area of 23.7 sq.m., excluding the dining area, located at the address: Petropavlovsk, Bostandykskaya St., 2, Dormitory No. 2, 1st floor. Term of property rental (lease): from October 15, 2024, to October 15, 2025. Monthly rent is at least 51,690 (fifty-one thousand six hundred and ninety) tenge including VAT, and additionally, utilities (electricity, heat, hot/cold water consumption).

Lot No. 2: Non-residential premises for a canteen, with an area of 47.1 sq.m., excluding the dining area, located at the address: Petropavlovsk, Abaya St., 31a, swimming pool, 1st floor. Term of property rental (lease): from October 15, 2024, to October 15, 2025. Monthly rent is at least 102,726 (one hundred and two thousand seven hundred and twenty-six) tenge including VAT, and additionally, utilities (electricity, heat, hot/cold water consumption).

Lot No. 3: Non-residential premises for a canteen, with an area of 49.7 sq.m., excluding the dining area, located at the address: Petropavlovsk, Pushkin St., 81, educational building No. 4, 1st floor. Term of property rental (lease): from October 15, 2024, to October 15, 2025. Monthly rent is at least 108,396 (one hundred and eight thousand three hundred and ninety-six) tenge including VAT, and additionally, utilities (electricity, heat, hot/cold water consumption).

Lot No. 4: Non-residential premises for a canteen, with an area of 25.4 sq.m., excluding the dining area, located at the address: Petropavlovsk, Pushkin St., 87, educational building No. 10, 1st floor. Term of property rental (lease): from October 15, 2024, to October 15, 2025. Monthly rent is at least 66,302 (sixty-six thousand three hundred and two) tenge including VAT, and additionally, utilities (electricity, heat, hot/cold water consumption).

4. Terms of the Competition for the Property to be Leased and Selection Criteria

4.1. The Commission opens the envelopes with the applications of potential tenants and compares the applications of potential tenants submitted within the established period and registered in the corresponding journal on the day of the deadline for submitting applications.

4.2. The winner of the competition is determined by the Commission by voting in evaluation sheets using a 5-point rating scale according to the selection criteria specified in the announcement. The winner is the potential tenant who scored the highest number of points. The basis for the Commission's decision is the application of the potential tenant with the most favorable lease terms for the Lessor, which meets or exceeds the requirements specified in the announcement.

Selection Criteria:

1.Service prices;

2.Work experience;

3.Proposed rental cost;

4.Presence of a network in the city;

5.Student employment;

6.Additional services.

4.3. In case of equal scores, the winner of the competition is determined by the chairman of the Commission or his deputy. In case of disagreement with the Commission's decision, any member of the Commission has the right to a dissenting opinion, which must be stated in writing and attached to the minutes of the 1  Commission meeting.  

4.4. If the winner of the competition refuses to conclude an Agreement with the Lessor, the Lessor has the right to conclude an Agreement with the potential tenant who took second place.

4.5. If an application to participate in the competition is submitted by only one potential tenant or if no applications have been submitted to participate in it, the competition to consider the issue of providing the object for lease is declared invalid. In this case, the secretary of the Commission draws up a protocol on declaring the competition invalid.

5. Deadline for Submission of Applications for Participation in the Competition

Applications for participation in the competition are accepted by the Competition Organizer until 15:00 local time on October 14, 2024, at the following address: 86 Pushkin Street, Petropavlovsk, office 208.

6. Standard Contract

Draft standard contract (Appendix 2 to the announcement).

7. Technical Specifications and Other Terms of Lease

Specified in the technical specifications (Appendix 1 to the announcement).

8. List of Documents Required for Participation in the Competition

8.1. On the front side of the sealed envelope containing the application for participation in the competition, the potential Tenant (lessee) must indicate:

Full name and postal address of the potential Tenant (lessee);

Full name and postal address of the Competition Organizer, which must correspond to the same information specified in this announcement;

Full name of the competition for which the potential Tenant (lessee) is submitting an application.

8.2. The application for participation in the competition is a form of expression of consent to participate by the potential Tenant (lessee) in the competition for the lease of premises for a cafeteria in accordance with the requirements and conditions established by the announcement.

8.3. The application for participation in the competition must contain:

Contact details, including: name, legal address (for legal entities), identity card (passport) number, surname, first name, patronymic, place of residence (for individuals), bank details of the potential Tenant (lessee);

Name, location, area of the object intended for lease;

Purpose of the lease;

Planned lease terms;

Confirmation that the potential Tenant (lessee) has read and agrees to the terms of the standard property lease agreement and the Rules by providing an original letter on company letterhead;

The proposed rent, which cannot be lower than the approved cost of leasing the non-residential premises and the fee for using the object;

Types of related services that the potential Tenant (lessee) will provide within the object;

Technical specifications and other proposals, including proposed investments, business plan, work on separable and inseparable improvements to the object, etc.

The application must be accompanied by notarized copies of the following documents or a certificate from the egov.kz portal system:

For legal entities – certificate of registration (re-registration) of a legal entity, certificate of all registration actions of a legal entity, Charter, license/permit and/or other document confirming the right to carry out a particular activity in accordance with the requirements of the technical specifications or in accordance with the legislation of the Republic of Kazakhstan;

For individuals – certificate of state registration of an individual entrepreneur (if available), identity document of an individual, address certificate.

In the case of maintaining a register of participants of a limited liability partnership, a notarized copy of an extract from the register of participants of the partnership is provided; 8.4. The application for participation in the competition is submitted by the potential Tenant (lessee) in writing, signed by the first manager or authorized person and sealed (if available) in a sealed envelope before the expiration of the deadline for submitting applications specified in the announcement.

10. Other Information

The commission, no later than 10 (ten) working days from the date of signing the protocol on the results of the competition, publishes information on the results of the competition on the Internet resource of NAO "M. Kozybayev North Kazakhstan University".
