Announcement of a Competition for the Lease of Space for a Coffee Stall Installation

This announcement regarding the "Lease of Space for the Installation of a Coffee Stall" competition (hereinafter referred to as the Announcement) is developed in accordance with the Rules for Leasing Non-Residential Premises of the Non-Profit Joint-Stock Company "North Kazakhstan University named after M. Kozybaev," approved by the decision of the Board of Directors of the Non-Profit Joint-Stock Company "North Kazakhstan University named after M. Kozybaev" dated March 29, 2021 (hereinafter referred to as the Rules), and the decision of the Board of Directors of the North Kazakhstan University dated August 28, 2023, in connection with the need to organize and provide catering for students and employees of the Non-Profit Joint-Stock Company "North Kazakhstan University named after M. Kozybaev" (the necessity of a food point).

Competition Title: "Lease of Space for the Installation of a Coffee Stall"

Organizer Name and Location: Non-Profit Joint-Stock Company "North Kazakhstan University named after M. Kozybaev", Petropavlovsk, Pushkina St., 86 (hereinafter referred to as the Organizer).

1. Date, Time, and Location of the Competition

The meeting of the competition commission to open the envelopes containing the applications from potential tenants for participation in the competition will be held at 3:00 PM local time on October 25, 2024, at the address: Petropavlovsk, Pushkina St., 86, Building 2, Room 208.

2. Place and Deadline for Submitting Applications for Participation

Applications for participation in the competition should be submitted by potential tenants (lessees) or their authorized representatives, acting on behalf of the applicant with a power of attorney, in a sealed envelope by 3:00 PM local time on October 25, 2024, at the following address: Petropavlovsk, Pushkina St., 86, Room 208.

Applications submitted after the specified deadline will not be accepted.

3. Brief Description and Information about the Lease Object, Including Location, Area, Lease Term, and Rent Amount Approved by the Non-Profit Joint-Stock Company "North Kazakhstan University named after M. Kozybaev"

The tenant must, within 5 working days from the signing of the Agreement, deposit into the landlord's account a deposit (guaranteed monetary payment) in the amount of 3 (three) monthly rents before receiving the non-residential premises under the Acceptance Certificate.

Lot: Non-residential space for the installation of a coffee stall, with an area of 9.1 m², including 25% access to common areas, located at: Petropavlovsk, International St., 26, Academic Building No. 5, 1st floor.Lease Term: From October 28, 2024, to October 28, 2025.

Monthly Rent: No less than 33,070 tenge (thirty-three thousand seventy) including VAT, plus utility costs for electricity, heating, and hot/cold water.

4. Conditions for the Competition and Selection Criteria

4.1. The commission will open the envelopes containing the applications and compare the submitted applications registered within the specified period on the day of the application deadline.

4.2. The winner of the competition will be determined by the commission through voting on evaluation sheets using a 5-point scale according to the selection criteria outlined in the announcement. The winner will be the potential tenant with the highest number of points. The commission's decision will be based on the application from the potential lessee offering the most favorable lease conditions for the landlord, which meet or exceed the requirements outlined in the announcement.

Selection Criteria:

1. Service prices;
2. Work experience;
3. Proposed rent amount;
4. Availability of a network in the city;
5. Employment of students;
6. Additional services.

4.3. In case of a tie in points, the winner will be determined by the Chairperson of the Commission or their substitute. If any commission member disagrees with the decision, they have the right to submit a written dissenting opinion, which will be attached to the commission meeting protocol.

4.4. In case the winner refuses to sign the Agreement with the landlord, the landlord has the right to enter into an Agreement with the second-place applicant.

4.5. If only one potential tenant applies or no applications are submitted, the competition will be deemed unsuccessful. In this case, the commission secretary will prepare a protocol stating that the competition was unsuccessful.

5. Deadline for Submitting Applications for Participation

Applications for participation in the competition must be submitted to the Organizer by 3:00 PM local time on October 25, 2024, at the following address: Petropavlovsk, Pushkina St., 86, Room 208.

The sample agreement (Appendix 2 to the announcement).

7. Technical Specification and Other Lease Conditions

As outlined in the technical specification (Appendix 1 to the announcement).

8. List of Documents Required for Participation in the Competition

8.1. The sealed envelope containing the application for participation must include the following on the front side:

1. Full name and postal address of the potential tenant (lessee);
2. Full name and postal address of the competition organizer, matching the details provided in this announcement;
3. Full name of the competition for which the application is submitted.

8.2. The application for participation in the competition signifies the potential tenant's agreement to participate under the terms and conditions outlined in the announcement.

8.3. The application must include the following information:

1. Contact details: name, legal address (for legal entities), ID number (passport), surname, first name, patronymic, residential address (for individuals), banking details of the potential tenant (lessee);
2. Name, location, and area of the object to be leased;
3. Purpose of the lease;
4. Planned lease terms;
5. Confirmation that the potential tenant has read and agrees to the terms of the standard lease agreement and the Rules by providing an original letter on official letterhead;
6. Proposed rent, which must not be lower than the approved rental rate;
7. Types of additional services to be provided by the tenant within the leased object;
8. Technical specification and other proposals, including proposed investments, business plan, improvements to the property, etc.;
9. Notarized copies of the following documents or certificates from the egov.kz portal must be attached:

For legal entities: registration certificate, certificate of all registration actions, Charter, license/permit, or any document confirming the right to engage in activities as required by the technical specification or Kazakhstan's legislation;

For individuals: individual entrepreneur registration certificate (if available), identity document, address certificate.

If applicable, a notarized copy of the partnership register extract must be provided for limited liability companies.

8.4. The application must be submitted in writing, signed by the head or authorized representative, and sealed (if applicable) in a sealed envelope before the application deadline specified in the announcement.

10. Other Information

The commission will publish the results of the competition no later than 10 working days after signing the protocol of the competition results on the website of the Non-Profit Joint-Stock Company "North Kazakhstan University named after M. Kozybaev."
